International Trademark Protection Enforcement
Remien Law, Inc. | International Trademark Protection & Enforcement
Trademarks are territorial in that they apply only in the particular country or jurisdiction in which they were registered. Currently there is no single system for filing or registering a trademark that will apply worldwide.
There are, however, systems to ease the registration of trademarks in various countries. These systems allow trademark owners to obtain protection in many jurisdictions by obtaining a single registration and filing any changes or renewals for all applicable jurisdictions through one administrative process.
The Madrid System is the primary international system for the registration of trademarks around the world and is administered by the World Intellectual Property Organization (WIPO). The owner, and sometimes the applicant, of a trademark in its home jurisdiction can apply for an international registration through WIPO, which can then be extended to the various member jurisdictions of the Madrid System.
The European Union (EU) offers a similar system through the Community Trademark (CTM) which allows a registration with the EU trademark office to apply across the entire EU.
